We often hear statements like, “judges must apply the law and not make the law.”  Experience, however, proves that no one really knows what phrases like this mean in the context of how judges actually decide cases.  In this presentation, Justice Richard L. Gabriel of the Colorado Supreme Court brings his years of judicial experience to bear in an effort to separate the myths from the realities regarding how judges actually decide cases, with a goal of fostering a better understanding of judicial decision-making in the real world.
